I. Scope
These general terms and conditions (“GTC”) shall apply to the booking and provision of hotel accommodation and related services provided by MEININGER Hotels to Guests and Customers (hereinafter referred to as “Contract”). The term “Customer” as used hereinafter means the individual or legal person who makes the booking and “Guest” means the individual in whose name the booking is made.
“MEININGER Hotels”, “Hotel”, “we”, or “us” shall signify the legal entity affiliated with the MEININGER Hotels group operating the hotel at the location specified in the Contract and set out in Annexure 1 of these GTC.
II. Basis of Contract
1. The Contract enters binding effect upon MEININGER Hotels acceptance of Customer’s booking request and provision of a booking confirmation number to Customer.
2. Up to 11 persons booking a hotel for the same period are considered individual travellers (“Individual Travellers”). Bookings for 12 persons or more are considered groups (“Groups”) to which the group terms apply unless specifically agreed upon otherwise.
3. Bookings for small groups of 12 up to 20 persons made online on the MEININGER website, are considered online-groups (“Online Groups“) and are governed by the terms for Individual Travellers. Group terms remain available for small Groups via the Groups sales channel upon request.
4. House rules of MEININGER Hotels are an integral part of the Contract and apply in combination with these GTC.
5. Upon conclusion of the Contract, Customer agrees to comply, and to ensure that all Guests comply, with these GTC.
III. Reservation, Services, Payment
1. We undertake to provide the accommodation and agreed related services booked by Customer.
2. Customer shall be obliged to make payment of the costs of hotel accommodation and agreed related services including value added tax, plus tourist or city tax or other local tax as and where applicable (“Charges”), either in full in advance, or progressively at the relevant time in accordance with the terms of the Contract, and latest upon check-in at the Hotel. Should the rate of value added tax, city tax or other local tax be increased between the time of booking and check-in at the Hotel, we will be entitled to adjust the Charges accordingly.
3. We may require Customer and/or Guest to present a valid debit or credit card in advance and latest upon check-in at the Hotel, to allow pre-authorization of sufficient funds for guaranteed booking and/or deposit payment.
4. Any request to change the dates or length of stay, to increase the number of Guests, change the accommodation type or add products and/or services will be subject to availability. To the extent the Charges for such amended booking would be higher than the original amount, the Customer shall pay the applicable higher amount of Charges in accordance with the amended Contract. Any amount paid on the original Contract shall only be refunded if the original booking was made on a refundable rate.
5. Advance and Pre-payments:
a) In the case of Group bookings made up to 8 weeks prior to arrival, an initial advance payment of 10% of the total Charges is due immediately upon confirmation of the booking. The remaining amount is due as an advance payment at the latest 30 days before arrival without our further request, unless otherwise agreed in writing.
b) In the case of Group bookings made within less than 8 weeks of arrival (“Short-Term Group Booking”), the Charges are due in full as an advance payment upon receipt of the booking confirmation.
c) Bookings of Online Groups require prepayment if stated in the respective online offer.
6. Special offers and discounts cannot be combined and the most favourable offer applies. The Hotel reserves the right to request appropriate proof of entitlement to be provided latest upon arrival.
7. Unless set out otherwise in the Contract, the payment term of invoices issued by the Hotel is 14 days from the date of the invoice. Thereafter, we reserve the right to charge interest at the statutory interest rate applicable within the jurisdiction at the place of the Hotel. We reserve the right to prove higher damages and may charge a reasonable reminder fee of EUR 8.00 (CHF 8.00; HUF 3,400; DKK 60; PLN 40.00) for each reminder.
8. Any bank charges, credit card chargeback and foreign exchange fees arising on payment of the Charges shall be borne by the Customer.
9. In case of a refund, we shall use the same payment method as used for the original payment.
10. The Customer can assert any rights of set-off and retention only if the underlying counterclaim is undisputed or confirmed by final court ruling.
11. Our Hotels are cashless. Exceptions may apply in certain jurisdictions; we may however deny accepting bank notes of high denomination value if in excess of the payment amount by more than EUR 30.00 (CHF 30.00; DKK 230.00; HUF 12,400.00; PLN 130.00).
12. If accommodation is not possible at the booked Hotel for a reason within our sphere of responsibility, we are entitled to accommodate Guest(s) in a different hotel of an equivalent standard without additional charge or cost to the Customer or Guest (“Walk Policy”).
13. Confirmations for visa applications are issued upon request, subject to payment of a fee of EUR 10.00 (CHF10.00; DKK 75.00, HUF 4,200.00; PLN 44.00) and subject to full advance payment of the Charges. The fee is non-refundable even in the event of cancellation of the booking or rejection of the visa application.
14. Specific terms for France: In accordance with article L.223-2 of the French Consumer Code, Customers are informed of the possibility of registering, free of charge, on the Bloctel website in order not to receive telephone solicitations from a professional with whom they have no current contractual relationship.
IV. Cancellation by the Customer / No-Show
1. Cancellation of bookings by Individual Travellers:
a) Cancellation is permitted free of charge upon notification of the Hotel until 6:00 p.m. (local time of the Hotel) on the day of arrival, unless set out otherwise in the Contract.
b) Cancellations after 6.00 pm on the day of arrival are subject to cancellations fees. The same applies in case the Customer fails to arrive before 6.00 pm without prior notice (“No-Show”). The calculation of the cancellation fee shall be made in accordance with the local industry standards, and no less than 90% of the applicable rate of the booking of the first night of the scheduled stay.
c) Bookings made with non-refundable rates cannot be cancelled free of charge; there will be no refund in case of partial or full cancellation of such booking.
d) In case of No-Show on non-refundable rates, the Hotel is obliged to maintain availability of the booked accommodation until midnight of the arrival date.
2. Cancellation of bookings by Groups:
Unless explicitly set out otherwise in the Contract, any Group booking can be cancelled for free up to 60 days prior to the arrival date. Thereafter, any group booking cancellation shall be subject to the following cancellation fees:
a) 59 to 30 days prior to the arrival date 10% of the agreed total Charges is payable.
b) 29 to 10 days prior to the arrival date 50% of the agreed total Charges is payable.
c) In the event of cancellation 9 or less days prior to the arrival date or No-Show, 90% of the agreed total Charges is payable.
3. Cancellation of bookings by Online Groups: same terms will apply as those applicable to Individual Travellers set out above.
4. If catering services are booked such can be cancelled free of charge up to 14 days before the arrival date. Thereafter a cancellation fee of 100% of such agreed charge shall apply.
5. To cancel a booking, the Customer shall notify us on the MEININGER website under “Manage my booking”. The same applies for notification of late arrival. In case the booking was made through a third-party supplier (e.g. online travel booking platform), all notifications shall be made to such third party.
V. Cancellation by the Hotel
1. The Hotel is entitled to terminate the Contract upon reasonable prior notice to the Customer, if
a) an advance payment or security deposit as per the Contract has not been paid in time;
b) bankruptcy, insolvency or settlement proceedings have been initiated against the Customer or a foreclosure decree has been issued in respect of any of the Customer’s assets;
c) the accommodation is booked based on misleading or incorrect statements of essential facts, e.g. concerning the Customer’s identity or the purpose of the stay;
d) the Hotel has reasonable grounds to believe that the use of the Hotel’s services may jeopardize the smooth operation of the business, the security or the reputation of the Hotel in public without this being attributable to the Hotel’s sphere of control or organization;
e) the Hotel’s inventory of rooms is reduced or unavailable due to circumstances which are not attributable to the Hotel’s responsibility;
f) in case of a Force Majeure event, whereby “Force Majeure” shall signify any circumstances beyond the Hotel’s control, including but not limited to acts of God, fire, explosions, adverse weather conditions, flood, earthquake, local terrorism, riot, civil commotion, war, hostilities, strikes, work stoppages, cyber-attack, lack of power, internet outage and materials shortages.
In case of the Hotel’s cancellation pursuant to Section V.1. e) or f) of these GTC, the Customer shall cooperate with the Hotel to minimize the effects of such cancellation to either party; any deposit or advance payment may be retained by the Hotel, if the Customer agreed to reschedule the stay at the Hotel to a mutually agreeable, alternative date.
2. The Hotel is further entitled to terminate the Contract extraordinarily and with immediate effect for good reason, if it discovers that:
a. the purpose or reason for the stay is unlawful;
b. there is re-letting and/or of sub-letting of the accommodation without prior approval of the Hotel;
c. there is contravention of the rules of stay for Guests of minor age (see Section VI, paragraph 9);
d. there is an infringement of the house rules.
3. If the identification document is not provided upon check-in, or if the identification fails, we may terminate the Contract. Payments made for bookings at a refundable rate shall be reimbursed.
4. If it has been agreed that the Customer may withdraw from the Contract free of charge within a certain period of time, the Hotel shall be entitled for its part to withdraw from the Contract within this same period of time if there are requests from other Customers for the period of the Customer’s scheduled stay, provided that the Customer waived its withdrawal rights upon the Hotel’s request within the reasonable timeframe set by the Hotel.
VI. Arrival and Departure, Other Provisions Regarding the Hotel Stay
1. We will try to accommodate any special requests, including with regards to room preference, however we do not guarantee other than room or dormitory type of accommodation (female/mixed dormitory).
2. Re-letting and subletting the rooms provided as well as using them for any purposes other than the Guest’s accommodation requires the prior written consent of the Hotel.
3. For Groups’ accommodation the Hotel will determine the rooms’ allocation and coordinate the distribution of beds with the Group’s representative.
4. The booked accommodation shall be available for check-in from 3:00 p.m. (local time of the hotel) on the agreed day of arrival. Subject to availability and prior agreement with the Hotel, early access to the accommodation may be granted against payment of an additional fee.
5. We expect the Customer to claim the accommodation at the Hotel by 6.00 p.m. (local time of the Hotel), of the agreed arrival date. Except in case of bookings at non-refundable rates, late arrival shall be notified to the Hotel prior to 6.00 p.m. at which point in time a payment guarantee (credit card payment) shall be provided at the latest via “Manage my booking” on the MEININGER website. In the case of non-guaranteed bookings, the Hotel has the right to assign the rooms to other parties after 6:00 p.m. without the Customer being able to derive any claims for compensation.
6. On the agreed day of departure, the Guest shall check-out before 11.00 a.m. (local time of the Hotel) unless a late check-out (until 2.00 p.m. local time of the Hotel) has been purchased with the booking or directly at the Hotel, subject always to availability. If the Guest does not check out by 11.00 a.m., or the agreed late check-out time, then we may charge the daily rate applicable at that time for the accommodation until the Guest’s check out.
7. For Groups, a list of all persons with full name and date of birth must be handed over to the Hotel at the latest 3 days prior to arrival, for Online Groups latest upon arrival.
8. If the total number of persons arriving exceeds the contractually agreed number of persons, there is no entitlement to accommodation for the additional persons.
9. Persons under the age of 18 are not permitted to stay in the dormitory, if not under a Group booking. Minors above 16 years can stay in a private room with their parents’ or legal guardians’ permission. The respective form 'authorization for underage person to travel' is available on the MEININGER website, Such form shall be signed and accompanied by a copy of the valid identity card of the parent or legal guardian. Minors below 16 years can stay in private rooms if accompanied by a parent, a legal guardian or an adult person duly authorized by the parent or legal guardian by signed consent form with copy of the valid identity card of a parent or legal guardian. For Groups, the due authorization of the adult(s) accompanying minors shall be evidenced latest 3 days prior to arrival, for Online Groups latest upon check-in. If due authorization is not evidenced in time, the Hotel may refuse to grant the accommodation. Specific terms for Italy and Hungary: Persons under the age of 18 may only stay at the Hotel if accompanied by a parent, legal guardian or an adult person duly authorised by the parents.
10. Children shall be accommodated in their own beds. A limited number of cots are available for Children younger than 3 years and shall be booked prior to arrival. Children may stay in upper bunks beds only from the age of 7 years. It is the responsibility of parents or legal guardians to supervise their children and to minimize the risk of accidents. Subject to availability and prior request, the Hotel may procure specific fall protection for children. The Hotel shall not be liable for any injury or damage caused by improper use of the Hotel’s facilities, e.g. of the bunk beds, stairs and galleries.
11. Accommodation in the Hotel’s dormitory shall not exceed 14 consecutive nights within any four-week period. In private rooms the admitted term per stay is limited to 30 consecutive nights per any period of two full calendar months.
12. Noisy large medical equipment (e.g. respirators/oxygen equipment) is only permitted in private rooms. The Hotel reserves the right to disallow the use of any other type of equipment causing nuisance to other guests.
13. Bringing pets is only permitted in private rooms. Pets must always be registered with the Hotel in advance and the Hotel has a right to refuse accommodation of pets in individual cases at its sole discretion. The Hotel charges a fee of EUR 15.00 (CHF 15.00; DKK 115.00; HUF 6,200.00; PLN 65.00) per pet per night.
14. When booking breakfast, breakfast is served following each overnight stay. If half-board or full board is booked, dinner will be served as the first meal on the day of arrival, unless otherwise agreed. The mealtimes will be agreed with the Hotel at the latest upon arrival. The Hotel will try to accommodate the desired mealtimes, but cannot guarantee specific times.
15. A valid identification document (identity card, passport or travel document) shall mandatorily be provided by all Guests staying in our Hotel. In some jurisdictions, the Hotel is obliged to scan and record the identification document of Guests including minors and infants.
16. We respect all gender in the same way and observe local cultural rules and legal regulations. Should the Guest’s self-identified gender vary from the identification document, the Hotel reserves the right to grant access to dormitory accommodation based on the information contained in the Guest’s identification document only. Creating a safe and welcoming environment for all our Guests is our core intention.
VII. Liability and Limitation of Liability
1. The Customer and the Guest shall be liable as joint debtors for all obligations arising under the Contract.
2. The Customer is liable for any loss, damage or extra cleaning cost to the Hotel or its inventory that was caused intentionally or negligently by the Customer or any Guests or visitor of any Guests they are responsible for. The Hotel reserves the right to request a deposit of up to EUR 500.00 (CHF 500.00; DKK 3,750.00; HUF 207,000.00, PLN 2,200.00.) per booking upon check in. Such deposit may be charged to the credit card provided at the time of booking. Should any loss or damage incurred by the Hotel exceed such deposit amount, the Hotel will request the compensation to be paid in full by the Customer. If there is no loss or damage established, the Hotel will unblock the deposit amount charged on the card latest 5 working days after the Guest(s)/’s departure.
3. Smoking (including e-cigarettes) is prohibited in all areas of the Hotel. In case of violation, the Hotel may charge a flat fee of EUR 250.00 (CHF 250.00; DKK 1,900.00; HUF103,400.00; PLN 1,070.00) for extra-ordinary cleaning efforts. Tampering with smoke alarms or unauthorized opening of emergency doors is equally prohibited. The Hotel reserves the right to claim damages if, for example, the Hotel is charged for a fire brigade operation or a fire caused by unauthorized smoking.
4. The Hotel shall be liable for the fulfilment of its obligations with the care and diligence of a prudent businessman. The Customer shall immediately notify the Hotel personnel at the reception of any disruptions or defects occurring in the Hotel’s service.
5. The Hotel shall solely be liable to the Customer or Guest for any direct loss or damage caused by gross negligence or wilful act, or omissions, except if mandatory strict liability applies pursuant to the applicable law. This limitation of liability shall not apply in case of bodily injury or death.
6. The Customer shall take any reasonable action to avoid damage and/or to keep damage to a minimum. This comprises supervisory caution to be exercised by parents and legal guardians for their children and minors, and due attention to personal belongings. Tour operators and Groups shall be liable for damages caused by members of the Group. The Hotel may request prove of adequate liability insurance cover being taken out by the tour operator or Group.
7. Charging batteries of e-bikes, e-scooters and similar is prohibited in hotel rooms.
8. Using the Hotel’s bike service is at the Guest’s own risk.
9. The Hotel recommends that the Guest safeguards belongings, valuables and precious objects in the lockers which are available at the Hotel. Cash money, securities and valuables can be kept in the safe of the Hotel at the reception upon request, however not exceeding a total value of the equivalent of EUR 5,000. The Hotel’s liability vis-à-vis the Customer for property brought into the Hotel shall be limited in accordance with the statutory local provisions.
10. Insofar as a parking space is made available to the Customer in the Hotel garage or in a Hotel parking lot, even for a fee, this does not constitute a custody agreement. The Hotel has no duty of supervision. In the event of loss of or damage to motor vehicles and their contents parked or moved on the Hotel's property, the Hotel must be notified immediately and no later than the Customer leaving the Hotel's property. The Hotel shall be liable only in accordance with the applicable statutory local provisions.
11. Upon the Customer’s request the Hotel may accept delivery of messages, mail and goods shipments for Customers around and during the Customer’s stay at the Hotel. The Hotel will take care of the delivery and safekeeping of any such items. Subject to the Hotel’s written acceptance, any such items may be forwarded to the home address of the Customer or a third party designated by the Customer; fees may apply.
12. The Hotel undertakes to duly safeguard any property of the Customer lost at the Hotel, if it is of value above the equivalent of EUR 10.00. Upon the Customer’s written request and payment of shipment fees, the Hotel will ship the lost property to the Customer. The Hotel may dispose of any lost property at its full discretion after a period of six (6) months from the date it was found.
13. Any circumstances which may lead to a claim against the Hotel shall be notified immediately upon taking knowledge of the potential for a loss or damage, mainly while the Guest is still on the Hotel’s premises. The Hotel’s liability shall otherwise be excluded except in case of bodily injury or death and where the Hotel’s statutory strict liability is duly evidenced.
VIII. Final Provisions
1. These GTC are duly made available to Customers and shall apply to all Contracts. We may change these GTC from time to time without notice with immediate effect. However, the version of the GTC in force at the time of the booking will continue to apply for such Contract.
2. These GTC shall be governed by the respective local laws applicable at the place where the Hotel is located. The application of the UN Convention on Contracts for the International Sale of Goods and the conflict of laws is excluded.
3. In case of disputes, conflicts and claims, which cannot be settled amicably, the competent court at the place where the Hotel is located shall have jurisdiction, unless explicitly agreed otherwise between the parties. Claims of the Hotel against Customer may be submitted at the competent courts of the Customer’s place of residence. Claims of the Hotel against a Customer with a registered business address may be brought to the competent courts of Berlin, Germany, where the Hotel’s headquarters are located.
4. In the event of a dispute with any of the MEININGER Hotels in France, the Customer may, in the absence of an amicable agreement, refer to the Mediator of Consumption to which the MEININGER Hotels in France report, namely AME CONSO, within one year of the written complaint addressed to MEININGER Hotels. Referral to the Mediator of Consumption must be made: (i) either by completing the form provided for this purpose on the AME CONSO website, or (ii) by mail addressed to AME CONSO, 197 Boulevard Saint- Germain - 75007 PARIS.
5. If any provision of these GTC is held by any competent authority or court to be invalid or unenforceable in whole or in part the validity of the other provisions of these GTC and the remainder of the provision in question shall not be affected.
6. These GTC shall prevail over the Customer's general terms and conditions, unless explicitly agreed in writing in advance.
7. MEINNINGER Hotels actively supports diversity and inclusion and welcomes every Guest regardless of ethnic origin, gender, religion, disability, age or sexual orientation, and we expect respect of these values.
8. We collect, use and process the Customer’s and Guests’ personal data in compliance with our Data Privacy Statement as published on the MEININGER website which explains what personal information we may collect, how and why we collect, store and use and share such information, your rights in relation to such personal information and how you can contact us and any supervisory authority if you have a query or complaint about the way in which we use any personal information.
